Terms of Use

1. Who these terms are between

These Terms of Use (the “Terms”) form a binding agreement between you and the operator of the Pause app and this website (“Pause”, “we”, “us”). If you do not agree with any part of these Terms, do not use Pause.

You must be at least 16 years old (or the minimum digital-consent age in your country, if higher) to use Pause. If you use Pause on behalf of an organisation, you confirm you are authorised to accept these Terms for it.

2. What Pause is — and what it is not

Pause reads activity and wellness information you choose to share (for example, from Apple Health) and reflects it back to you as everyday, non-clinical language. It is intended only for general wellness, motivation and self-reflection.

Pause is not a medical device and does not:

• diagnose, treat, cure, mitigate or prevent any disease, injury or medical condition;
• provide medical, clinical, nutritional, psychological, physiotherapy or professional advice of any kind;
• replace consultation with a qualified physician or other licensed health professional;
• monitor, detect or alert you to any medical event or emergency;
• provide results that are validated, calibrated, clinically accurate or fit for any diagnostic purpose.

Any wording in the app that sounds encouraging, cautionary or interpretive is a general impression only. It is not an assessment of your health and must never be relied on to make a health decision.

3. Always consult a professional

Always seek the advice of a physician or other qualified health provider with any question you have about a medical condition, symptom, medication, exercise programme or dietary change. Never disregard professional medical advice, or delay seeking it, because of something you read in Pause.

If you think you may have a medical emergency, call your local emergency number immediately.

4. Physical activity — assumption of risk

Exercise and changes to activity, rest or diet carry inherent risks, including injury and, in rare cases, serious harm or death. You use Pause and act on anything you see in it entirely at your own risk and on your own judgement. You are solely responsible for deciding whether any activity is appropriate for you, and you should obtain medical clearance before beginning or changing an exercise routine.

5. No guarantees

We make no promise, representation or guarantee about any outcome — fitness, weight, recovery, longevity, wellbeing, performance or otherwise. Results, if any, vary from person to person. We also do not guarantee that Pause will be uninterrupted, error-free, available in your country, compatible with your device, or that any data, calculation or text it displays will be accurate, complete or current.

6. Data sources and third parties

Pause depends on data supplied by your device, operating system, sensors and services such as your device’s health data, and may use third-party infrastructure and automated text generation. We do not control those sources, cannot verify their accuracy, and are not responsible for their errors, gaps, delays or outages.

7. Your account and acceptable use

You are responsible for your device, your credentials and all activity under your account, and for the accuracy of the information you enter. You agree not to:

• use Pause for any unlawful purpose or in breach of any applicable law or regulation;
• use Pause in any clinical, diagnostic, emergency, employment-screening or insurance context;
• reverse engineer, decompile, scrape, copy, resell or create derivative works from the app or its content;
• interfere with, overload or attempt to gain unauthorised access to the service or its systems;
• upload another person's health information without their informed consent.

8. Intellectual property

Pause, its name, logo, design, text, models, methodology and all related content are owned by us or our licensors and are protected by intellectual-property laws. We grant you a personal, limited, revocable, non-exclusive, non-transferable licence to use the app for your own non-commercial use. Content you provide remains yours; you grant us the licence needed to operate and improve the service.

9. Subscriptions, purchases and Apple

Any paid features are sold through the Apple App Store and are subject to Apple’s terms. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period, and are managed in your Apple ID settings. Refunds are handled by Apple under its policies; we cannot process App Store refunds.

These Terms are between you and us, not with Apple. Apple is not responsible for the app or its content, has no obligation to provide support or maintenance, and is a third-party beneficiary of these Terms with the right to enforce them. Any claim relating to the app’s failure to conform to a warranty is our responsibility, subject to these Terms and applicable law. You confirm you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and are not on any U.S. restricted-party list.

10. Disclaimer of warranties

To the maximum extent permitted by law, Pause is provided “as is” and “as available”, without warranties of any kind, express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment or non-infringement.

Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you. Nothing in these Terms removes rights you have as a consumer that cannot be waived under the law of your country.

11. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data, goodwill, health outcome, injury, or business interruption, arising out of or connected with your use of, or inability to use, Pause — even if we have been advised of the possibility of such damages.

Our total aggregate liability for all claims relating to Pause is limited to the greater of (a) the amount you paid us for the app in the twelve months before the event giving rise to the claim, or (b) USD 50.

We do not exclude or limit liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded.

12. Indemnity

You agree to indemnify and hold us harmless from any claim, loss, liability, cost or expense (including reasonable legal fees) arising from your use of Pause, your breach of these Terms, or your violation of any law or third-party right.

13. Changes, suspension and termination

We may modify, suspend or discontinue any part of Pause, and may update these Terms, at any time. Material changes will be signalled by updating the date at the top of this page and, where appropriate, in the app. Continued use after changes take effect means you accept them. You may stop using Pause and delete the app at any time.

14. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which the operator of Pause is established, without regard to conflict-of-law rules, and the courts of that jurisdiction have non-exclusive jurisdiction. If you are a consumer, you keep the benefit of any mandatory protections and the right to bring proceedings in the courts of your country of residence.

Before starting any formal proceedings, please contact us so we can try to resolve the matter informally.

15. General

If any provision of these Terms is found unenforceable, the remainder stays in force. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy, are the entire agreement between us about Pause.
